Discussion of Article 33 on Town Meeting Warrant with Jan Plaue of the Open Space Committee. Ms. Plaue returned as promised (see minutes of March 6, 2002) to present information on the five parcels of town-owned land which Open Space Committee proposes to Williams Pond: Ms. Plaue stated that the assessed value is $428,200 and that its location in the Park contributes to its value. Helen Wilson, having done a site visit, described the terrain as very steep between the high (.83 acres upland) and low areas; she added that she was unsure whether Section 40B (on affordable housing) would allow access through anyone elseChequessett Neck Road: Plaue stated that the land is mostly high, across the street from low land, which presents a concern about septic systems if developed. She added that the assessment is $65,000 and that ConsCom would like to have this land protected.
Drummer Cove Marsh: In the brief discussion of this parcel, it was noted that the land was low.
Paine Hollow Road: Here, Plaue explained, there is a little more wetland than high land. Lisa Brown commented that almost an acre is buildable; Helen Wilson stated her surprise that it was classified as upland, since she felt it was low and wet; the Chair, however, asserted that it was definitely dry to the east of driveway. Plaue stated that the neighbor does not have the right to have a driveway on the land but stated that there was not clear information on this. The Chair asked whether it would be better for the town to offer it for sale to allow this access and place a conservation restriction on it. Gerry Parent added that this would put it back on the tax rolls.
Gull Pond Road: Ms. Plaue commented that at the ConsCom meeting on the parcels, the person who lives across the road from this parcel and who, therefore, has interest in keeping it open, stated that the property would be destroyed if building were attempted.
Plaue concluded her discussion by stating that the town has Helen Wilson commented that putting this land under ConsCom control represented an extra layer of protection, additional to their wetlands protection. She asked Ms. Plaue if Open Space had met since last Tuesday and was told it had not.
Plaue described possible uses of the different parcels. Mark Berry inquired to determine that people were not restricted from using them.

Helen Wilson stated that environmental regulations sit on every piece of property and that, in a sense, there doesnDavid Wright pointed out that the proposal was being brought to Planning Board by two town committees, ConsCom and Open Space, and asked whether the Board did not trust their judgment. Her findings were (1) any absence from discussion because of conflict of interest prevents signing the plan and (2) any absence for illness, etc. prevents both voting and signing. To certify the plan, the people signing it must be a majority of the people who voted on it (Section 81L of Subdivision Control Law). She also had gathered information on two other questions:
It is legal to be lobbied by people outside of meetings, but not to the point of intimidation.
It is discretionary whether one leaves the room when recusing oneself, but it is better to do so.

Lisa Brown moved and Mark Berry seconded adjournment. The meeting was unanimously adjourned at 9:25 p.m.
